The result of that historical approach in the field of civil liability was parents’ immunity from civil liability, which is called "the parents’ immunity rule from civil liability against their children". However, as time passed and changes occurred in the field of tort law, history underwent a new chapter, and parents’ immunity rule from civil liability against their children was altered from its absolute and unconditional form so that children could be covered and supported by individual rights; consequently, its special protections and immunity turned into liability in numerous cases. This research demonstrates that in the current law, civil liability of parents against their children has progressed from being "personal" to the "collective" civil liability and even to the "state compensation" stage for damages incurred by children. In our legal system, along with the use of progressive views of Islamic jurisprudence in regard with "Zaman Aqele (liability of the male members of families)", part of which includes liability of Jarire and compensation by relatives and compensation by the Islamic treasury (or Beytolmal) as well, which is compensation by the government, a new viewpoint has been established toward compensation through social contracts such as insurance and social security, on the one hand, and the government, on the other. Therefore, the legislator can hold the government responsible by formation of “Civil Liability Insurance Funds” through enacting the required law for the events in which there are no sources of compensation or legal bases of financial capability for compensation. This paper illustrates the fact that the scope of the mentioned rule has been widely reduced in English law, and also the fact that its exceptional application has been accepted in Iranian law. Hence, it can be said that the rule of “parents’ immunity from civil liability” has moved out from its absolute form and has entered the history of law. سیر تاریخی و تکامل مسؤولیت مدنی والدین در مقابل فرزندان در دو نظام حقوقی ایران و انگلیس حکایت از پذیرش اختیار مطلق برای والدین درخصوص فرزندان دارد تا جایی که می‌توان از منظر تاریخی از اقتدار بی قید و شرط والدین بر زندگی فرزندان سخن راند. رهاورد این رویکرد تاریخی در حوزه مسؤولیت مدنی، مصونیت از مسؤولیت مدنی برای والدین بود که از آن تحت عنوان «قاعده مصونیت از مسؤولیت مدنی والدین در برابر فرزندان» یاد می‌شود؛ امّا با گذر زمان و تحولاتی که درحوزه حقوق مسؤولیت مدنی رخ داد، بار دیگر تاریخ ورق خورد و قاعده مصونیت از مسؤولیت مدنی والدین در مقابل فرزندان، از حالت مطلق و بدون قید و شرط خود خارج گردید تا فرزندان نیز در پناه حقوق فردی مستقل و حمایت‌های ویژه آن قرار گیرند و به این ترتیب در موارد عدیده‌ای مصونیت به مسؤولیت تبدیل شد. پژوهش حاضر نشان می‌دهد که در حقوق کنونی، مسؤولیت مدنی والدین در مقابل فرزندان از «شخصی» بودن مسؤولیت مدنی به سمت «جمعی» شدن و حتی به مرحله «جبران دولتی» خسارت فرزندان پیش رفته است. در حقوق ما با بهره‌گیری از دیدگاه مترقی فقه اسلامی در باب «ضمان عاقله» که بخشی از آن شامل ضمان جریره و جبران خسارت توسط بستگان می‌شود و همین طور جبران خسارت از طریق بیت‌المال، یعنی جبران توسط دولت، طرز تلقی جدیدی به جبران خسارت به وسیله قراردادهای اجتماعی از قبیل بیمه و تأمین اجتماعی از یک طرف و دولت از طرف دیگر شکل گرفته است. به این ترتیب، قانونگذار می‌تواند از طریق تصویب قانون، در مواقعی که منبع جبران خسارت وجود ندارد یا منبع قانونی توانایی مالی برای جبران خسارت را ندارد، با تشکیل «صندوق‌های بیمه مسؤولیت مدنی» جبران را بر عهده حکومت بگذارد. مقاله حاضر نشان از تخصیص اکثر خوردن این قاعده در حقوق انگلیس و استثنایی بودن آن در حقوق ایران دارد؛ به طوری که در حال حاضر می‌توان گفت: قاعده «مصونیت والدین از مسؤولیت مدنی” از حالت مطلق آن خارج شده و به تاریخ حقوق پیوسته است. https://clr.modares.ac.ir/article_13925_e7f9ef5ab27988091ed7ba2cae40384e.pdf
