In this research, we have collected materials in a library manner and, using a descriptive-analytical method in analyzing the existing materials, we have concluded that ideas whose ambiguities have been reduced to some extent are compatible with trade secrets, and if they meet the necessary conditions for protecting trade secrets according to the new Iranian Industrial Property Protection Law, this system can be considered an appropriate vehicle for protecting the possible rights of idea owners.</span><br><br><br><br><br><br>  <span lang="AR-SA" style="font-family: 'B Yagut'; color: black; background: white;">در نظام حقوقی ایالات­متحده در حمایت از ایده­ها تلاش­های قابل‌توجهی در قالب پنج نظریه حقوقی صورت پذیرفته که نقطه عطف آن، حمایت از طریق نظام حقوق اسرار تجاری است؛ نظامی که با کم­ترین ایراد نظری نسبت به سایر نظریات و پیش­بینی مسئولیت­های مدنی و کیفری ابزار قانونی مناسبی برای صاحبان ایده می­باشد. ما در این پژوهش به ­صورت کتابخآن‌های به جمع­آوری مطالب پرداخته و با استفاده از روش توصیفی- تحلیلی در تجزیه‌وتحلیل مطالب موجود، به این نتیجه رسیده‌ایم که ایده­هایی که تا حدی از ابهامات آن‌ها کاسته شده است، قابل انطباق با سرّ تجاری هستند و در صورتی که واجد شرایط لازمه در حمایت از اسرار تجاری با توجه به قانون جدید حمایت از مالکیت صنعتی ایران باشند، این نظام می­تواند به­عنوان محمل مناسبی در حمایت از حقوق احتمالی صاحبان ایده قرار گیرد</span><span dir="LTR" style="mso-bidi-font-family: 'B Yagut'; color: black; background: white;">.</span> https://clr.modares.ac.ir/article_27953_fa517434b82355390c5cb9831685d6a0.pdf
