هم افزایی دادگاه های تجاری بین المللی و داوری تجاری بین المللی در مناطق ویژه اقتصادی |

با تاسیس و توسعه مناطق ویژه اقتصادی، بروز اختلافات تجاری بینالمللی روند افزایشی داشته و تمرکز بر شیوههای حقوقی حل و فصل اختلافات مذکور، بخشی از استراتژی دولتهای ذیربط بوده است. داوری تجاری بینالمللی به عنوان یک شیوه مرسوم و مقبول حل و فصل اختلافات در مناطق ویژه اقتصادی است. با این وجود برخی دولتها بنابر ضرورتهای عملی، در دو دهه اخیر، اقدام به تاسیس دادگاههای تجاری بینالمللی در این مناطق نمودهاند. برخی ویژگی‌های دادگاههای تجاری بینالمللی که الگوبرداری از قواعد و شیوههای داوری بین المللی است، عبارتند از: انعطاف‌پذیری بیشتر در رسیدگی‌ها، امکان انتصاب قضات با ملیت خارجی، اجازه حضور وکلای خارجی در دادگاه، اجازه طرفین برای توافق بر انجام رسیدگیهای خصوصی و گسترش قابلیت اجرای احکام. همچنین برخی خلاهای داوری تجاری بین المللی که تا حدودی در دادگاههای تجاری بینالمللی تعدیل گردیده، عبارت است از: امکان ورود ثالث، افزایش سرعت رسیدگی و استقلال و بی طرفی مرجع رسیدگی کننده. به لحاظ عملی نیز شاهد رابطه تعاملی دوسویه میان این دو نهاد هستیم زیرا از یک سو، داوری تجاری بینالمللی نقش مهمی در تأسیس دادگاههای تجاری بینالمللی چه در اروپا و چه در آسیا داشته است و از سوی دیگر، دادگاههای تجاری بینالمللی نیز نقش فزایندهای در رسیدگیهای داوری ایفا میکنند و برای انجام و توسعه فرآیند داوری و یا تضمین اجرای آرای داوری مساعدت قضایی ارائه میدهند. با توجه به چشمانداز عملکرد دادگاههای تجاری بینالمللی، مطالعه تطبیقی آنها در جهت ارائه الگوئی مطلوب و متناسب با مقتضیات هر کشور اقدامی ضروری به نظر می رسد.

With the establishment and development of special economic zones focusing on the legal methods of the settlement of disputes has been part of the strategy of the relevant governments. International commercial arbitration is a common and accepted way of resolving disputes in special economic zones. However, due to practical needs, some governments have established international commercial courts in these regions in the last two decades. Some features of these courts modeled on the rules and methods of international arbitration are: greater flexibility in proceedings, the possibility of appointing foreign judges and lawyers in the court, allowing the parties to agree on conducting private proceedings and expanding the ability to enforce judgments. Also, some gaps in the arbitration, which have been adjusted to some extent in international commercial courts, are: the possibility of a third party entering, increasing the speed of proceedings, and the independence and impartiality. In practical aspect, there is an interactive relationship between these two institutions because on the one hand, international commercial arbitration has played an important role in the establishment of international commercial courts in both Europe and Asia. And on the other hand, international commercial courts also play an increasing role in arbitration proceedings and provide judicial assistance or to ensure the implementation of arbitration awards. Considering the future perspective of international commercial courts, their comparative study seems to be a necessary step in order to provide a suitable model that fits the requirements of each country. |
