عنوان فارسی تمایزهای بانک‌ها از شرکت‌های تجاری و تأثیر این تمایزها بر نظام ورشکستگی (مطالعه تطبیقی در حقوق آمریکا و ایران)
چکیده فارسی مقاله بانک­ها به دلیل نقش خاصی که در اقتصاد کلان دارند و نیز به دلیل این که مجموعه منحصر به فردی از خدمات را به سطح عموم جامعه ارائه می­دهند، توجه قانونگذاران را به خود جلب کرده­اند. توجه به ورشکستگی بانک­ها و تأثیرات بسیار منفی آن به ویژه از بحران بزرگ اقتصادی که در سال 1929 در آمریکا شروع شد و پس از آن به تمام دنیا سرایت کرد، آغاز شد و قانونگذاران به این نتیجه رسیدند که مقررات عام ورشکستگی شرکت­ها برای رسیدگی به ورشکستگی بانک­ها کفایت نمی­کند. بنابراین، در اکثر نظام­های حقوقی دنیا هنگامی که یک شرکت تجاری ورشکست شود، بر اساس مقررات عام ورشکستگی به آن رسیدگی می­شود؛ اما اگر یک بانک ورشکست شود سعی شده است با توجه به ماهیت خاص و متفاوت بانک­ها در اقتصاد کشور و تفاوت­هایی که با سایر شرکت­های تجاری دارد، مقررات خاصی برای ورشکستگی آن­ها در نظر بگیرند. ایالات متحده آمریکا از جمله نظام­هایی است که در آن مقررات راجع به ورشکستگی بانک­ها با مقررات حاکم بر ورشکستگی شرکت­ها به طور کامل تفاوت دارد. در حقوق ایران هر چند مانند حقوق آمریکا نظام ورشکستگی بانک­ها به طور کامل از نظام ورشکستگی شرکت­ها جدا نیست، اما در صورتی که بانکی ورشکست شود، مقررات قانون تجارت در زمینه ورشکستگی، مقررات عام محسوب می­شوند و سایر مقررات پولی و بانکی، مقررات خاص به حساب می­آیند و نتیجه این است که در صورت سکوت مقررات خاص، مقررات عام قانون تجارت در زمینه ورشکستگی اعمال می­شود.

عنوان انگلیسی Bank differentials from companies and the effect of these distinctions on bankruptcy regime (comparative study in American and Iranian law)
چکیده انگلیسی مقاله Due to the particular role they play in macroeconomics and the fact that they offer a unique set of services to the general public, banks have attracted attention of legislators. Considering the bank's bankruptcy and its very negative effects, especially since the great economic crisis that began in 1929 in the United States and then spread to the whole world, began and the legislators concluded that the general rules of bankruptcy of companies to handling insolvency of banks is not enough. Therefore, in most legal systems of the world, when a business company is bankrupt, it is governed by general bankruptcy rules. But if a bank goes bankrupt, it has tried to consider specific rules for their bankruptcy considering the specific nature of banks in the country's economy and the differences with other commercial companies. The United States is one of the systems in which bankruptcy regulations of banks are completely different from corporate bankruptcy regulations. In Iranian law, though,unlike the US the bankruptcy system of banks is not completely separate from the bankruptcy system of the companies, and if the bank goes bankrupt, the rules of the bankruptcy act are considered to be general regulations and other monetary and banking regulations are specific rules, and the result is that, in the absence of specific provisions, apply the bankruptcy rules of commercial act are implemented.
