عنوان فارسی گسترش قلمرو شرط داوری از طریق رضایت مفروض
چکیده فارسی مقاله داوری نهادی قراردادی است. قرارداد داوری است که تعیین می­کند چه کسی می­تواند در دیوان داوری خواهان یا خوانده قرار گیرد.توسعۀ شرط داوری به اشخاص ثالث معارض با ماهیت آن می­باشد.مبانی گسترش قلمرو شرط داوری را با نگاه به رویۀ داوری بین­المللی و ادبیات موجود می­توان به دودسته کلی تقسیم کرد: دسته اول شامل مواردی است که با نادیده گرفتن شخصیت حقوقی شرکت مادر، سهام‌داران یا شرکتهای زیرمجموعۀ آن می­تواننددردیوان داوری طرف دعوا قرار گیرند یا اینکه با نادیده گرفتن شخصیت حقوقی مستقل شرکت تحت مالکیت وکنترل شرکت مادر، شرکت مادررا خوانده قرار دهند.دردسته بعدمواردی مطرح شده که با یافتن نشانه­های از رضایت شخص ثالث، می­توان قلمرو شرط داوری را بر مبنای رضایت مفروض گسترش داد. نمایندگی، استاپل و گروه قراردادها به عنوان مبانی گسترش قلمرو شرط داوری بر اساس رضایت مفروض مطرح شده­اند.

عنوان انگلیسی Expansion of the Scope of Arbitration Clause Based on Presumed Consent
چکیده انگلیسی مقاله Arbitration is an agreement. The arbitration agreement determines who can be as plaintiff or defendant. Development of an arbitration clause to the third parties  is in conflict with  its nature. Foundations widen the scope of the arbitration clause with regard to international arbitration practice, and  the literature can be divided into two types. The first category includes items that, by ignoring the legal entity's parent company, shareholders or its subsidiary companies, can be arbitral tribunal parties, or by ignoring independent legal entity owned and controlled by parent company. In the next category, by finding signs of the issues raised by the consent of a third party, we can be expand the scope of an arbitration clause based on presumed consent.Agents, Estoppels and group of companies' theory as a basis for extension based on presumed consent have been raised.
