چکیده موضوع نظام حقوقی حاکم بر اجرای انتخابات به‌عنوان یک ساز و کار پیش‌بینی شده در قوانین اساسی، قوانین موضوعه و عرف‌های اساسی کشورهای مختلف برای برگزاری یک انتخابات دقیق و سالم مورد اشاره قرار گرفته است. اهمیت و نقشی که نظام مدیریت اجرایی انتخابات در برگزاری یک انتخابات مدبرانه ایفا می‌کند در نسبت مستقیمی با سلامت، شفافیت و صحت جریان انتخابات قرار می‌گیرد. در رویه عملی کشورها، تاکنون سه الگوی مستقل، دولتی و مختلط یا ترکیبی برای نهاد مدیریت انتخابات به رسمیت شناخته شده است و از این زاویه می‌توان به طبقه‌بندی کشورهایی که از این الگوها تبعیت می‌کنند، پرداخت. در واقع هدف اساسی از ایجاد نهادهای انتخابات بر مبنای الگوهای مذکور، تضمین حداکثری صیانت از آرای شهروندان و در نهایت برگزاری یک انتخابات عادلانه است. اگرچه با توجه به برخی شاخص‌ها می‌توان مدیریت اجرایی انتخابات را به چند الگو تقسیم کرد، اما در نهایت نمی‌توان با قطعیت ادعا کرد که فرایند برگزاری انتخابات در چند کشور با یک الگو، به‌صورت یکسان اجرا می‌گردد؛ بدین معنا که نوع مدل نهاد مدیریت انتخابات به‌طور قطعی نمی‌تواند مبین نوع فرایند همسان برگزاری انتخابات در کشورها باشد. مقاله حاضر به بررسی حقوقی نظام‌های سهگانه مدیریت اجرایی انتخابات در دنیا اشاره داشته، با برشمردن اصول حاکم بر عملکرد نهاد مجری انتخابات، به بررسی، تحلیل و ارائه پیشنهاد درخصوص نظام اجرایی انتخابات در ایران می‌پردازد. *نویسنده مسؤول مقاله: Email:danyal.mashhud@gmail.com |

The legal system governing the administration of elections as a mechanism has been mentioned at the constitutions, statute law and the fundamental customs of the different countries managing accurate and fair election. The significance and rule of the election administration system holding an advised election, has a direct ratio with healthy, clarity and accuracy of the election progress. In the practical praxis of countries, the independent, governmental and mixed models have been formally recognized; as countries following this model can be classified from this viewpoint. In fact, according to the given models, the basic purpose of making electoral institutions is the maximum guaranty of the protection of citizens' votes, and finally, performing a fair election. Although, based on some indicators, the executive management can be divided into several models, it is not possible to decisively assert that the process of implementation of the election in some countries with similar model hold equally; in other words, the model type of the institution of election administration cannot conclusively indicate the implementation of similar process of election of countries. This article tries to legally examine the Triple Systems Executive Management (TSEM) of election in the world and mentioning the Principles of ruling the activity of election institutions.
