حقوق فرهنگی در نظام بین‌المللی حقوق بشر؛ حرکت کم‌شتاب در بستر پرتلاطم

چکیده
حقوق فرهنگی طیف وسیعی از حقوق انسانی را شامل می‌شود. بسیاری از حق‌ها و آزادی‌های انسانی یا در مجموعه حقوق فرهنگی قرار دارند و یا برای تحقق صحیح آن‌‌ها به حقوق فرهنگی نیاز است. همچنین تحقق بسیاری از حق‌ها به صورت غیرمستقیم با حقوق فرهنگی پیوند دارد. به همین جهت، بسیاری از مصادیق حقوق فرهنگی به‌منزله مبنا و بنیاد بهره‌مندی از سایر حقوقبشر قلمداد می‌شوند. با همه اهمیت حقوق فرهنگی، نظام بین‌المللی حقوقبشر در این حیطه علی‌رغم پشت سر نهادن روندی پر اُفت و خیز برای کامل شدن، نه تنها هنوز امیدهای بسیاری را پاسخ نگفته، بلکه نگرانی‌های متنوعی را نیز دامن زده است. در مطالعات روزافزون حقوقبشر در سراسر دنیا همچنان سهم بررسی‌های مربوط به حقوق فرهنگی و شکل‌گیری فکر و اندیشه در این زمینه مطلوب نیست و پرسش‌های متعدد بی‌پاسخ باقی مانده است. نوشتار حاضر با ملاحظه مهم‌ترین اسناد بین‌المللی ذیربط و تحقیقات علمی جهانی در حیطه حقوق فرهنگی، کوششی است با این هدف که روند شناسایی حقوق فرهنگی را در نظام بین‌المللی حقوقبشر مشخص سازد، نکات محوری مربوط به حقوق فرهنگی را در نظام بین‌المللی حقوقبشر بیان کند، عناصر حقوق فرهنگی را از یکدیگر تفکیک نماید و مبتنی بر بررسی‌های یاد شده، به طور فشرده روشن سازد که چه فرصت‌ها، چالش‌ها و موانعی فراروی تحقق حقوق فرهنگی در جهان معاصراست. ارائه پیشنهاد و توصیه‌های نظری و کاربردی برای باروری هر چه بیش‌تر مباحث حقوق فرهنگی در فرایند تلاش‌های آتی، رهاورد مقاله حاضر است.
