مطالعه تطبیقی انسانگرایی در حقوق بین الملل سنتی و معاصر

چکیده
حقوق بین الملل مجموعه اصول و مقرراتی است که برای تنظیم روابط تابعان فعال حقوق بین الملل یعنی دولتها و سازمانهای بینالمللی با یکدیگر در جامعه بین المللی به کار میرود. حاکمیت دولتها در شکلگیری چنین مقرراتی نقش محوری داشته است. با این حال در چند دهه اخیر شاهد تضعیف این حاکمیت دولتها به نفع بشر و بشریت بودهایم. توجه به حقوق بشر و ایجاد گفتمانی غالب در مناسبات بین المللی در خصوص بشر و منافع بشریت باعث گردیده حاکمیت مطلق و وستفالیایی دولتها رنگ باخته و با مسئولیت دولتها در حفظ حقوق بشر گره خورد. بیشک اندیشههای انسانگرایی در شکلگیری چنین فرآیندی بیتأثیری نبوده است.این تحقیق سعی دارد با روشی توصیفی تحلیلی، به بررسی این فرآیند بپردازد.
