حقوق مالکیت ادبی و هنری آثار تتو (خالکوبی) با تأکید بر دکترین حقوقی آمریکا و حقوق ایران

چکیده
استفاده از تتو (خالکوبی) بهعنوان ابزاری برای آرایش یا بیان برخی افکار و عقاید، در سطح جامعه، بهویژه بین جوانان و نوجوانان در حال گسترش است. این واقعیت، بیانگر ضرورت توجه به مسائل حقوقی مرتبط با تتو، از جمله حقوق مالکیت ادبی و هنری آثار تتو است. نتایج این مقاله توصیفی-تحلیلی نشان میدهد در آمریکا، دکترین حقوقی غالب، شرایط اعطای حق مؤلف، یعنی اصالت، قرار گرفتن اثر در زمره آثار تألیفی و تثبیت در حامل مادی را در مورد تتو محقق میداند. هرچند تحقق شرط اخیر، به دلیل تثبیت تتو در پوست انسان، با ایراداتی از قبیل امکان محو تتو با استفاده از لیزر یا تغییرات پوست و نظریه اشیای کاربردی مواجه شده که البته این ایرادات بیپاسخ نمانده است. در حقوق ایران، حمایت از آثار تتو که مخالف نظم عمومی و اخلاق حسنه نباشند، به شرط اصالت و تجسم خارجی و انتشار برای نخستین بار در ایران، امکانپذیر است؛ بنابراین، در حقوق هر دو کشور، با تفاوتهایی در شرایط ایجابی و سلبی، حمایت از آثار تتو امکانپذیر است. در عین حال، با توجه به قرار گرفتن تتو بر پوست انسان، اعمال حقوق مادی و معنوی دارنده با محدودیتهای استفاده منصفانه و لیسانس ضمنی مواجه خواهد بود.
