بازخوانی مفهوم قانون به عنوان منبع تولید قاعده‌ی حقوقی در اندیشه‌ی میرزا ملکم خان

چکیده
از نیمهی دوم قرن نوزدهم میلادی و در سالهای ابتدایی سلطنت ناصرالدین شاه قاجار، میرزا ملکم خان اصطلاح جدیدی را به ادبیات حقوقی ایران وارد کرد: «قانون»؛ اما آنچه ملکم خان قانون مینامید، با قانون به مثابه منبع حقوق مدرن صرفاً مشترک لفظی است و تفاوتهای بنیادین دارد. لذا، تبیین مفهوم قانون در اندیشه‌ی او برای تفکیک آن از معنای امروزین خود اهمیت دوچندان مییابد. پژوهش حاضر در صدد است قانون برساختهی ملکم خان را از یک سو در پرتو منابع حقوق معتبر در دوران قاجار، یعنی فرمانهای شاه و قواعد فقهی و از سوی دیگر در مقایسه با مفهوم قانون در حقوق مدرن فرانسه مطالعه کند. این مطالعه قصد دارد نشان دهد ملکم خان با مطالبهی قانون در پی ایجاد چه تحولی در منابع حقوق موجود بوده است و چه کاستیهایی در این منابع او را به سمت خواست منبع جدید سوق داده است. پژوهش با رویکرد تحلیلی-تبیینی و با روشی تاریخی نشان خواهد داد که ملکم خان خواهان قانونی است که توسط دولت وضع شود و بیانگر قواعد حقوقی عام باشد. در دیدگاه او، قانون به مثابه منبع انحصاری حقوق در درون مبانی حقوق سنتی جای میگیرد و به کار بردن اصطلاح قانون مساوی با «حاکمیت قانون» نیست. قانون او از نظر ماهوی سنتی و از نظر شکلی مدرن است.
