From Reviewing the French Oversight System to Designing an Optimal Model for Supervising the Employment Rights of Persons with Disabilities in Iran

Abstract
Despite the recognition of employment rights for persons with disabilities in Iranian law including the three-percent hiring quota and the obligation of executive bodies to ensure workplace accessibility the practical enforcement of these rights is hindered by weak oversight, institutional fragmentation, and the absence of effective mechanisms for addressing employment discrimination. In contrast, in France, the Defender of Rights, functioning similarly to an ombudsman, plays an active role in ensuring equal employment opportunities for persons with disabilities through general recommendations, mediation, and institutional independence. The aim of this study is to examine the institutional capacities of the French oversight system and to design a model for enhancing the role of the Iranian General Inspection Organization (GIO) in supervising the employment rights of persons with disabilities. Using a descriptive analytical and comparative method, and through an examination of the functions of the Defender of Rights, the research shows that several of these functions including continuous monitoring of disability employment conditions, evaluating the implementation of protective legislation, and issuing institutional reports and warnings can be aligned with the legal mandates of the GIO in Iran. The findings indicate that the optimal model can be achieved by strengthening the existing capacities of the GIO and expanding its supervisory, independent, and mediatory roles. Accordingly, by establishing coherent mechanisms for monitoring the employment rights of persons with disabilities, analyzing the performance of administrative bodies, and providing reform proposals to decision-making authorities, an effective and accountable oversight system for enforcing these rights can be realized. This approach, while avoiding governmental expansion and institutional proliferation, enables the functional realization of an ombudsman-like mechanism within Iran’s existing oversight structure.
