پژوهش های حقوق تطبیقی

مفهوم و آثار حقوقی وام غارت‌گرانه و راهکارهای مقابله با آن در حقوق ایران و آمریکا

چکیده
وام غارت‌گرانه به شیوه‌هایی از اعطای وام اطلاق می‌شود که در آن وام‌دهنده با سوءاستفاده از ناآگاهی، اضطرار یا ضعف اقتصادی وام‌گیرنده، شرایطی غیرمنصفانه، ناعادلانه یا فریب‌کارانه را به او تحمیل می‌کند. این پدیده که عمدتاً در حوزه وام‌های مصرفی و مسکن مشاهده می‌شود، آثار حقوقی و اجتماعی متعددی به دنبال دارد؛ از جمله نقض اصل انصاف قراردادی، اخلال در نظم عمومی اقتصادی و تحمیل زیان‌های سنگین به وام‌گیرندگان. در این مقاله با استفاده از شیوه تحلیل- توصیفی، ابتدا مفهوم و ویژگی‌های وام غارت‌گرانه تبیین و سپس آثار حقوقی آن در چهارچوب نظام‌های حقوقی ایران و ایالات متحده آمریکا بررسی شده است. هدف این مقاله، فراهم‌سازی زمینه‌ای برای ارتقا حمایت حقوقی از مصرف‌کنندگان مالی و ارتقای عدالت قراردادی در معاملات پولی است. اهدافی که با رسمیت­دادن به تئوری حسن‌نیّت در قراردادها به مثابه الزامی قانونی، تحقق می­یابد.
