بازخوانی انتقادی نظریه کنترل و تعادل قوا در نظام حقوق اساسی ایالات متحده آمریکا

چکیده
نظام کنترل و تعادل قوا، تفسیری کارکردگرایانه از نظریه سنتی تفکیک قوا است که با هدف افزایش کارآمدی این نظریه و تضمین حقوق و آزادی‌های مردم در برابر فساد قدرت طراحی شده است. این نظام که نمونه بارز آن در ساختار حقوقی ایالات متحده آمریکا قابل مشاهده است، بر مبانی و پیش‌فرض‌هایی در اندیشه سیاسی طراحان خود استوار بوده و اهداف خاصی را دنبال می‌کرده است. بااین­حال، شواهد حاکی از ناکامی این نظریه در دست‌یابی کامل به اهداف مورد­نظر است. این پژوهش، با بهره‌گیری از روش توصیفی - تحلیلی و با استفاده از داده‌های کتابخآن‌های، به بررسی این سؤال اصلی پرداخته است که آیا نظام کنترل و تعادل قوا در ایالات متحده توانسته به اهداف طراحی‌شده خود دست یابد؟ نتایج این مطالعه نشان می‌دهد که ابهامات پیرامون پیش‌فرض‌ها و مبانی و همچنین ناکارآمدی این نظام در تحقق اهداف اصلی خود، از جمله مهم‌ترین دلایل ضعف این نظریه در ساختار حقوقی آمریکا و الگوگیری از آن محسوب می‌شوند.
