پاسخگویی دولت: جایگاه، ارکان و پیش‌شرط‌‌ها

چکیده
چکیده پاسخگویی به‌عنوان یکی از مؤلفه‌‌های حکمرانی مطلوب همواره مورد توجه پژوهشگران حوزه حقوق عمومی و سیاست بوده است. علیرغم توجه پژوهشگران حقوقی به مفهوم پاسخگویی، همچنان مفهوم پاسخگویی و ارکان آن در هاله‌ای از ابهام قرار دارد و در مواردی این مفهوم با مفاهیم مشابه خود خلط می‌‌شود. این نوشتار بر آن است که با تعریف دموکراسی به هدف اصلی آن یعنی تخصیص قدرت و تنظیم آن، به معنای پاسخگویی دست پیدا کند. پاسخگویی براساس این تعریف از دو رکن مهم پاسخ دادن و اجبار تشکیل شده است که دستیابی به هریک از این ارکان نیازمند دستیابی به پیش‌شرط‌‌های پاسخگویی، یعنی شفافیت و حکومت قانون است. بی‌شک روشن ساختن جایگاه پاسخگویی در دموکراسی و حکمرانی مطلوب در درک بهتر این مفهوم راهگشا خواهد بود. با وجود این، مقاله حاضر به دنبال مفهوم حداکثری و ایدئال پاسخگویی نیست و معتقد است مفهوم پاسخگویی امری مرتبه‌ای است که ممکن است در مواردی مرتبه‌ای از آن وجود داشته باشد. * نویسنده مسؤول مقاله: Email: mdjalali@gmail.com
