مطالعه تطبیقی عملکرد دولت‌های انگلستان، آمریکا و فرانسه در دیالکتیک امنیت و آزادی در مبارزه با تروریسم

چکیده
در شرایط عادی، امنیت و آزادی به عنوان دو حق بشری باید در هر جامعه‌ای برقرار باشد تا ارزش‌ها و اصول انسانی مورد حراست قرار گیرند؛ امّا دولت‌ها در مواجهه با شرایط اضطرار ناشی از تروریسم ممکن است برای جمع میان دو حق بشری آزادی و امنیت دچار چالش شوند. رویکرد غالب اتخاذی توسط کشورها رویکرد امنیت محورانه است. در این جستار ابتدا، قوانین و آراء قضایی کشورهای انگلستان، فرانسه و آمریکا مورد بررسی قرار می‌گیرد و تبیین می‌گردد که دولت‌ها در این شرایط، اغلب آزادی را برای برقراری امنیت نادیده می‌گیرند. در مقابل، رویکرد آزادی محورانه قرار دارد که در مواجهه با تروریسم با برقراری آزادی، امنیت را تا حدودی نادیده می‌گیرد و این رویکرد به دلیل تمایل به رویکرد امنیت‌محورانه از سوی دولت‌ها اصولاً توسط دولت‌ها قابل اتخاذ نیست و تنها می‌توان صبغه‌هایی تاریخی از اتخاذ این رویکرد توسط دولت‌ها یافت. سرانجام با بررسی‌های بیشتر در این خصوص می‌توان به این نتیجه رهنمون شد که در برقراری تعادل میان امنیت و آزادی جانب تعدیل را نگه داشته و در شرایط اضطرار ناشی از تروریسم، حتّی‌الامکان به محدود‌سازی حق‌های بشری تخطی پذیر اقدام نمود؛ به گونه‌ای که هیچ یک از دو حق بشری امنیت و آزادی به بهانه برقراری دیگری دچار خدشه نشود.
