هوش مصنوعی و صدور احکام کیفری؛ تصمیم سازی یا تصمیم‌گیری؟

چکیده
نقش‌آفرینی فناوری‌های مرتبط با هوش مصنوعی در دانش حقوقی بسان اکثر رشته‌های علمی دیگر قابل‌توجه می‌باشد. علوم جنایی حقوق محور و نظام عدالت کیفری نیز از حضور این فناوری بی‌بهره نمانده و استفاده از سیستم‌های مرتبط با هوش مصنوعی در مراحل مختلف رسیدگی‌های کیفری در بسیاری از کشورهای توسعه‌یافته اجرایی می‌باشد. سؤال اساسی آن‌که آیا فناوری‌های مرتبط با هوش مصنوعی در مرحله مربوط به صدور حکم کیفری نیز قابل توصیه بوده یا خیر؟ و در فرض اعمال، چه چالش‌هایی پیش روی آن است؟ پژوهش توصیفی و تحلیلی حاضر حاکی از آن است که: تأثیرگذاری احساسات شخصی در رسیدگی‌های قضایی، عدم دقت و سرعت کافی در رسیدگی به پرونده‌ها، اعمال تعصبات و سلایق فردی و سوگیری‌های آگاهانه یا ناآگاهانه، از جمله مهم‌ترین دلایل توجیه ضرورت بهره‌مندی از فناوری‌های هوش مصنوعی در مرحله صدور حکم است؛ اما در این مسیر، پوشاندن ردای قضاوت آفت این مسیر بوده و چالش‌هایی همچون جانب‌داری، عدم شفافیت، انسان زدایی در فرایند تصمیم‌گیری و همسان گرایی در قضاوت را به همراه خواهد داشت. بر این بنیاد، حضور هوش مصنوعی به عنوان ابزاری تصمیم‌ساز، تسهیل گر و دستیار در مرحله صدور حکم کیفری قابل توصیه است؛ اما استفاده از این فناوری به شکل تصمیم‌گیر و مستقل، مخالف با اقتضائات قضاوت و کیفردهی آموزه‌ای مدرن بوده، گسست‌های آیینی به همراه داشته و سهم انسان در برقراری عدالت را زیر سؤال خواهد برد.
