امکان‌سنجی کاربست دستور منع آزار در برابر خشونت‌های خانگی در سیاست جنایی ایران: رویکرد تطبیقی به نظام کامن‌لا

چکیده
آسیب‌های ناشی از جرایم ارتکاب‌یافته در بستر خانواده، به‌خصوص خشونت‌های خانگی یکی از مهم‌ترین چالش‌های اجتماعی و حقوقی در سراسر جهان است که با تهدید نهاد خانواده، پیامدهای جبران‌ناپذیری بر افراد، به ویژه زنان و کودکان، برجای می‌گذارد. سیاست‌گذاران جنایی در کشورهای مختلف با تدوین و کاربست دستور منع آزار سعی در کاهش این جرایم و حمایت از قربانیان داشته‌اند. علی‌رغم وجود قوانینی همچون قانون حمایت خانواده و قانون مجازات اسلامی در ایران، به نظر می‌رسد سیاست جنایی موجود در قبال حمایت از قربانیان جرایم و خشونت‌های خانگی ناکارآمد است. این مقاله به روش توصیفی - تحلیلی پس از بررسی مفاهیمی همچون عدالت پیشگیرنده، دستورات پیشگیرندهی مدنی و دستور منع آزار، به بررسی مواد قانونی مربوطه در کشور بریتانیا، سازوکارهای صدور این دستورات، مبانی سیاست‌گذاری و پیامدهای این دستورات می‌پردازد. یافته‌های این پژوهش نشان می‌دهد که طراحی و اجرای قوانین جامع‌تر، افزایش آگاهی عمومی، افزایش منابع مالی و انسانی و تقویت سازوکارهای حمایتی و بازتوانی در کنار کاربست دستورات منع آزار پس از آسیب‌زدایی از آن‌ها، می‌توانند به طور مؤثری در کاهش خشونت خانگی و بهبود کارآمدی سیاست جنایی ایران تأثیرگذار باشند.
